1. Agreement to Terms

By accessing Clutch DMS, you agree to these terms. If you don't agree, don't use the service.

2. Use License

We grant you a non-exclusive license to use the Service for your dealership operations. You may not: (a) modify or copy materials, (b) use for commercial purposes outside your dealership, (c) reverse engineer software, (d) remove copyright notices, or (e) use for unlawful purposes.

3. Pre-Revenue Early Access Deposits

$1,499 deposits are fully refundable until data extraction begins. After extraction, the deposit applies as account credit toward your first 12-month subscription. You can cancel anytime within 30 days post-launch with pro-rata credit.

4. Disclaimer

The Service is provided "as is" without warranties. Clutch DMS disclaims all warranties including merchantability, fitness for purpose, and non-infringement.

5. Limitation of Liability

Clutch DMS is not liable for damages from use or inability to use the Service, including lost profits or business interruption.

6. Your Data and Rights

You retain all rights to your dealership data. You grant Clutch DMS a license to use your data to provide the Service, improve our AI co-pilot, and analyze platform usage. You can request data export or deletion anytime.

7. Modification of Terms

We may revise these terms at any time. Continued use means acceptance of the updated terms.
